For claims involving amounts greater than $25,000.00, you must commence your claim in the Superior Court of Justice in order to be fully compensated for all of your losses. The decision to bring a claim in the Small Claims Court or in the Superior Court of Justice involves a thorough consideration of a variety of factors, chief amongst which include the severity of any injuries sustained and the complexity of the litigation. If a claim is commenced in the Small Claims Court then your recovery will be limited to the $25,000.00 monetary limit, and any recoverable amounts in excess of that monetary limit will have to be abandoned.
