Toronto Motorcycle Accident FAQ

| Personal Injury Lawyer

The following article is designed to answer some of our clients’ most commonly asked questions regarding motorcycle accidents. Questions of fault often arise during our discussions with clients. In our experience, we find that fault determinations may be difficult and are often case and fact scenario-dependant.

Toronto Motorcycle Accident FAQ

In general, fault determinations will be determined on a percentage basis and thus, we encourage motorcyclists to do all they can to avoid being deemed at fault. This includes complying with mandated laws and reducing dangerous riding behaviours that could lead to further apportionment of fault.

For example, it is imperative as a motorcycle rider that you wear a helmet and appropriate gear. Not only are helmets shown to statistically and significantly reduce the likelihood of serious skull and head injuries and death, but they are also mandated by law. Under the Highway Traffic Act Section 104(1), anyone who operates a “motorcycle or motor assisted bicycle” is required to wear a helmet with a fastening chin strap. Failure to do so will likely lead to an assessment of contributory damages in your claim.

We also suggest that motorcyclists take the utmost care while operating their vehicle on the road. This includes being respectful of the rules of the road. Furthermore, reducing driver negligence by reducing driver distractions are also important factors to consider. Speeding or impaired operation of a motorcycle play a large part in the frequency and severity of motorcycle accidents.
